PRIVACY POLICY ON THE PROCESSING OF PERSONAL DATA

(Articles 13 and 14, EU Regulation of April 27, 2016, No. 679 on the protection of personal data “GDPR”)
Abraham Industries S.r.l, owner of the brands Liviana Conti, Semicouture, Erika Cavallini and Circus Hotel, cares about the protection of your personal data and the respect of your privacy.

This information concerns you if:

- you intend to register on one of the websites of the brands owned by Abraham Industries S.r.l. [www.livianaconti.com – www.semicouture.it – www.erikacavallini.com - www.circushotel.it];

- you want to subscribe to our newsletters or receive promotional and commercial communications regarding the products of the above-mentioned brands;

- you have requested information about our products or services;

- you are interested in working with or for our company.

We ask you to read this privacy policy carefully to fully understand how we process your personal data.
We also remind you that any third-party websites referred to or linked via this Website are the exclusive responsibility of the third parties who manage them and are therefore governed by specific and independent Terms and Conditions and Privacy Policies.

1. Who is the Data Controller?
The Data Controller of your personal data is Abraham Industries S.r.l., (VAT No. 01729810406) with registered office in Via Fosse Incrociate 284, 47822 Santarcangelo di Romagna (RN), e-mail: info@abrahamindustries.it, certified e-mail: abrahamindustries@pecmail.net. The Data Controller is the person who determines the methods, purposes and means of processing your personal data.

2. Who is the Data Protection Officer?
The Data Processor is Smart Compliance Solutions for you s.r.l., reachable at the e-mail address: dpo@abrahamindustries.it The Data Protection Officer is assigned the responsibilities listed in Art. 39 of Regulation (EU) 2016/679 (hereinafter also “GDPR”).

3. What personal data do we process, for what purposes and how long will they be stored?
Personal data means any information that allows identifying a natural person. For the purposes that will be indicated, the Data Controller needs to use the following personal data:

a) to create your account, you will be asked to provide your first and last name, your date of birth and your email address; to process your purchase order and deliver the purchased products, you will be asked to provide the shipping and billing address and your phone number; to manage your order or return requests, you will find a summary of the orders made in the reserved area of your personal account. Personal data will also be used to send you communications about the status of purchase orders or your requests and for the issuance of accounting documents. The legal basis that legitimizes the aforementioned processing lies in Art. 6, par. 1, lett. b) and c) of the GDPR. In fact, such personal data are strictly functional to the fulfillment of pre-contractual and contractual obligations and compliance with legal obligations, including administrative, tax and accounting obligations. You may request the deletion of your account at any time. However, we remind you that accounting documents will be kept for ten years from the provision of the service, as required by current regulations. The Data Controller also undertakes to periodically verify accounts that have been inactive for over five years and proceed with their deletion, after notification.

b) to respond to requests you may send through the specific contact form on the Website, you will be asked to provide your first and last name and your email address to which the response will be sent. These data will be processed with your explicit and free consent pursuant to Art. 6, par. 1, lett. a) GDPR and kept for the time strictly necessary to respond to your requests.

c) to send promotional, commercial and advertising communications, in the form of newsletters, as well as soft marketing communications such as those aimed at assessing satisfaction with products or services already purchased and conducting market research on product categories similar or complementary to those already selected, you will be asked to provide your email address. The activation of the service can be requested regardless of the creation of a personal account. The data collected for this purpose will be processed with your explicit and free consent pursuant to Art. 6, par. 1, lett. a) GDPR. These data will be kept for the period in which the newsletter service is active or not interrupted by you. You may unsubscribe from the service, also limited to only one of the Group’s Brands, by clicking the link available at the bottom of each communication received.

d) to send you personalized promotional or commercial communications based on your purchasing habits. For this purpose, we may process the data collected through your interactions with our services (e.g. purchases made, categories of products chosen, frequency of purchases), in order to analyze your consumer preferences and improve our commercial offer by proposing content aligned with your interests. These analyses are in any case not related to automated decision-making processes. These data will be processed with your explicit and free consent pursuant to Art. 6, par. 1, lett. a) GDPR and kept for 36 months. At the end of the retention period, the data will be automatically deleted or permanently and irreversibly anonymized, unless you choose to renew your consent to continue using the service. It is specified that this purpose is only achievable if the data subject has created a personal account or if there is an active individual profile. Without an account or active profile, any consent given for this purpose will have no effect and will not be further processed.

e) to evaluate your spontaneous job application submitted through the “work with us” page, we ask you to provide your first and last name, your email address, your mobile phone number, one or more preferred sectors, and to upload your curriculum vitae. The data collected for this purpose will be processed with your explicit and free consent pursuant to Art. 6, par. 1, lett. a) GDPR and kept for 12 months.

4. Is the provision of data mandatory?
The provision of your personal data required for the processing under point 3 letter a) is mandatory, and if you refuse to provide it, it will not be possible to complete the purchase. For the processing under point 3 letters b), c), d) and e), the provision of your data is entirely optional but necessary to use the service or to evaluate your job application.

5. Who may receive your personal data
Your data may be accessed by employees and/or collaborators of Abraham assigned to manage orders or respond to your requests. Your data may also be accessed by third parties appointed as “Data Processors,” such as, for example, consultants and IT and logistics service providers supporting the Website operations. You have the right to obtain a list of any appointed Data Processors upon request. The personal data processed will not be disclosed in any way and, if transferred to third countries, an adequate level of data protection equivalent to that of the EU will be guaranteed. The regulation on third-party cookies, as described in the Cookie Policy, remains unaffected.

6. How can you get information on your data, modify, delete it or get a copy?
At any time, under the conditions provided for by Articles 7 and 15 to 22 of Regulation (EU) 2016/679, you may exercise the following rights: request information about the existence of your personal data, their origin, purposes and methods of processing and, if present, access personal data and information; request the updating, rectification, integration, deletion, limitation of data processing when one of the conditions provided in Article 18 of the GDPR applies, transformation into anonymous form or blocking of personal data processed unlawfully, including data whose storage is not necessary in relation to the purposes for which the data were collected and/or subsequently processed; object, in whole or in part, for legitimate reasons and as provided by law, to the processing of data, even if pertinent to the purpose of the collection and to the processing of personal data carried out for commercial information purposes or sending advertising material or direct sales or for carrying out market research or commercial communication. Each user also has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal; receive their personal data, processed based on a contract or the data subject’s consent, knowingly and actively provided or through the use of the service, in a structured, commonly used and machine-readable format, and transmit them to another data controller without hindrance; lodge a complaint with the Data Protection Authority in Italy.

7. What security measures do we adopt and what advice do we give you to protect your personal data
We process your data with the highest security: we have adopted physical, IT, and organizational measures to ensure the protection of your data. However, you too can actively contribute to protecting your privacy by following some simple recommendations:
- create complex passwords, using a combination of uppercase, lowercase, numbers, and symbols;
- avoid using the same password for multiple accounts and change it regularly;
- do not share your credentials with others and keep them in a safe place.
Be cautious of phishing attempts and do not provide your personal data in response to suspicious emails. We are constantly working to improve our security measures and ensure you a secure environment where your data is always protected.

8. From whom do we receive personal data
We mainly collect your personal data directly from you, for example when you register on our sites, place an order, subscribe to our newsletter, contact us for information or participate in initiatives organized by us. In some cases, we may also receive your personal data from social media platforms, if you have voluntarily participated in one of our advertising or promotional campaigns through such channels. In these cases, the data is processed in compliance with the privacy settings you have chosen on the platforms themselves and in accordance with applicable regulations. We ensure that all data collected, whether directly or through third parties, will be processed exclusively for the stated purposes and in compliance with the principles of transparency and security.

9. Can this privacy policy change over time?
This privacy policy may be updated. In the event of substantial changes to the way personal data is processed, we will promptly notify you.
